Data Protection Notice (Information Requirements according to article 13 of the General Data Protection Regulation (GDPR)

Data protection should in our opinion be transparent, easy to understand and, in particular, fair for all parties. Therefore, in this data protection notice we would firstly like to advise you of which of your personal data we collect and use, whether and if so to which third parties this information may be passed, how long we save the data and which rights you have, should you not at some point be in agreement with the responsible way in which we handle your data. 2. Collection of Personal Data in the Case of Informational Use

2.1

2.1. Every time you access our website, we collect the following information on your computer: the IP address of your computer, the request of your browser as well as the time of this request. Furthermore, the status and the data volume transferred with regards to this request is collected. We also collect product and version information on the browser used and the operating system of your computer. We furthermore note the website from which access is made to our website. The IP address of your computer is only saved for the period of your use of the website and is subsequently immediately deleted or anonymised by being shortened. We use this data for operating our website, in particular in order to determine and remove errors from the website, in order to determine the capacity of the website and in order to make adjustments or improvements. The legal basis for this processing is article 6, para. 1, letter f of the General Data Protection Regulation (GDPR).

3. Cookies & Local Storage

3.1

3.1. We may also collect information on your use of our website by using so-called browser cookies. These are small text files which are saved on your data carrier and which save specific settings and data for exchange with our system via your browser. One cookie usually contains the name of the domain from which the cookie data has been sent as well as information on the age of the cookie and an alphanumeric identification sign. Cookies allow our systems to recognise the user’s device and make possible default settings immediately available. As soon as a user accesses the platform a cookie is transmitted to the hard drive of the computer of the respective user. Cookies help us to improve our website and be able to offer you a better service tailor made to you. They allow us to recognise your computer when you return to our website and thereby:

  • to save information on your preferred activities on the website and thereby to align our website to your individual interests. This includes, for example, advertising which corresponds to your personal interests.
  • to accelerate the speed of your requests being processed.

3.2. The cookies we use only store the data explained above about your use of the website. This does not occur via an allocation being made to you personally, rather through the assignment of an identification number to the cookie (“Cookie ID”). The merging of the Cookie ID with your name, your IP address or with similar data, allowing for the allocation of the cookie to you, does not occur.

3.3. A distinction is made between session cookies which are deleted as soon as you close your browser and permanent cookies which are saved beyond the individual session. With respect to their function, a distinction is made in turn with cookies between:

  • Technical Cookies: these are absolutely necessary, in order to move around on the website, to use basic functions and to guarantee the security of the website; they neither collect information on you for advertising purposes nor do they save which websites you have visited;
  • Performance Cookies: these collect information on how you use our website, which pages you visit and for example whether errors occur when using the website; they do not collect any information which could identify you - all collected information is anonymous and is only used in order to improve our website and to find out what interests our users;
  • Advertising Cookies, Targeting Cookies: these serve to offer website users needs-orientated advertising on the website or offers from third parties and to measure the effectiveness of these offers; Advertising and Targeting Cookies are saved for a maximum of thirteen months;
  • Sharing Cookies: these serve to improve the interactivity of our website with other services (e.g. social networks); Sharing Cookies are saved for a maximum of thirteen months.

3.4. Each use of cookies which is not absolutely technically necessary represents data processing which is only permitted with your express and active consent, pursuant to section 25, para. 1 of the Telecommunications and Telemedia Data Protection Act (TTDSG), and also only takes place in compliance with this statutory provision. This applies, in particular, to the use of Advertising, Targeting or Sharing Cookies. Furthermore, we only pass on your personal data processed by cookies to third parties if you have issued your express consent to this according to section 25, para. 1 of the TTDSG.

3.5. Apart from technically necessary cookies which we set on your computer according to section 25, para. 2, no. 2 of the TTDSG, we are currently not using any cookies.

3.6

3.6. You can determine yourself via the settings in your browser whether cookies can be set and accessed. You can completely deactivate the saving of cookies in your browser, limit it to specific websites or configurate your browser in such a way that it automatically informs you as soon as a cookie is meant to be set and it requests you to respond. You can block or delete individual cookies. This can however for technical reasons lead to several functions of our web presence being compromised and no longer fully operating.

4. Data Security

4.1

4.1. All information which you submit to us is saved on servers within the European Union. Unfortunately, the transmission of information via the internet is not fully secure which is why we cannot guarantee the security of data transmitted via the internet to our website. We safeguard out website and other systems, however, via technical and organisational measures against the loss, destruction, access to, changing or circulation of your data by unauthorised persons. In particular, your personal data is transmitted with us in an encrypted form. In this respect, we use the coding system SSL (Secure Socket Layer) and/or TLS (Transport Layer Security).

5. No Transfer of Your Personal Data

5.1

We do not transfer your personal data to third parties, unless you have consented to this data transfer or we have the right to or are obliged to transfer data based on statutory provisions and/or official or judicial orders. This can in particular be provision of information for the purpose of law enforcement, hazard prevention or enforcement of intellectual property rights.

6. Data Protection and Websites of Third Parties

6.1

The website may contain hyperlinks to and from websites of third parties. If you follow a hyperlink to one of these websites, please be aware that we cannot assume any responsibility or guarantee for third-party content or data protection provisions. Please verify the respective prevailing data protection provisions before you transfer personal data to these websites.

7. Use of Functions of our Website

7.1

In addition to the purely informative use of our website, we offer various services which you may use if interested. For this you usually have to provide further personal data which we use for providing the respective service. If additional voluntary details are possible these are respectively indicated.

7.2

When contacting us by e-mail or via the contact form, your e-mail address and, if you enter them, your name and telephone number are saved by us so we can respond to your questions. (Legal basis is article 6, para. 1, page 1, letter b of the GDPR).

8. Social Media Profiles

8.1

We have a presence on several so-called social media platforms. We are featured at the following providers

We rely on the technical platform and the services of the provider for these information services. Please note that you use our presence on social media platforms and their functions at your own responsibility. This, in particular, applies to the use of interactive functions (e.g. comments, shares, likes). When you visit our pages the providers of the social media platforms collect, amongst others, your IP address as well as other information which is available in the form of cookies on your end device. This information is used in order to provide us as operators of the account with statistical information on interaction with us. The legal basis is respectively your consent: for setting cookies it is section 25, para. 1 of the TTDSG, for subsequent data processing it is article, 6, para. 1, letter a of the GDPR.

8.3

The data collected on you in this connection is processed by the platforms and possibly transferred to countries outside of the European Union, in particular the USA. All of the aforementioned providers meet an appropriate level of data protection level according to their own statements which corresponds to that of the former EU-US Privacy Shield and we have agreed standard data protection clauses with the companies. We are not aware of how the social media platforms use the data from you visiting our account and interaction with our posts for their own purposes, how long this data is saved for and whether data is passed to third parties. Data processing may differ according to whether you are registered and logged in to the social network or are visiting the page as a non-registered and/or non-logged-in user. When accessing a post or the account the IP address allocated to your end device is transmitted to the provider of the social media platform. If you as a user are currently logged in, your movements on the web can be traced via a cookie on your end device. It is possible for the platforms via buttons which are integrated in the web pages to record your visits to these websites and to allocate them to your respective profile. Based on this data, content or advertising can be offered to you in a tailor-made manner. If you wish to avoid this, you should log off and/or deactivate the function “remain logged on”, delete the cookies existing on your device and restart your browser.

8.4

We as provider of the information service process furthermore only the data from your use of our service which you provide to us and require interaction. If you, for example, pose a question which we can only answer by e-mail, we will save your information according to the general principles of our data processing which we describe in this privacy statement. The legal basis for processing your data on the social media platform is article 6, para. 1, page 1, letter f of the GDPR.

8.5

In order to exercise your rights of persons affected you may contact us or the provider of the social media platform. If a party is not responsible for responding or has to obtain the information from the other party, we or the provider will pass your request on to the other party. Please contact the operator of the social media platform directly for questions regarding profiling, the processing of your data when using the website. In the case of questions regarding your interaction with us on our web page, please write to the contact details provided by us above.

8.6

The providers describe the information which the social media platform receives and how this is used in their privacy statements (see link in the above table). There you will also find information on contact opportunities as well as the setting options for adverts. 9. Recipients or Categories of Recipients

9.1

If we pass your personal data on to third parties, you will be explicitly notified of this in the description of the respective data processing (e.g. when using our contact form). As a matter of course we furthermore use external service providers for technical and organisational processing with whom we have entered into respective order processing agreements within the meaning of article 28 of the GDPR. These are, for example, service providers for web hosting, sending e-mails, maintenance and care of our IT systems etc.

10. Storage Period

10.1

Your data will be saved for as long as is absolutely necessary for achieving the respective purpose, at the most however as long as possible statutory provisions demand this from us (e.g. commercially we are obliged to keep business letters, which also includes e-mails, for ten years).

10.2

As soon as the storage purpose has expired or a retention period prescribed by the named provisions has expired, personal data will be routinely blocked or deleted.

11. Your Rights

11.1

You have extensive rights with respect to the processing of your personal data. Firstly, you have an extensive right to information and may, if applicable, demand for your personal data to be corrected and/or deleted and/or blocked. You may also demand a limitation of processing and have a right to object as well as a right to data portability. 11.3. Right to Object

Individual Right to Object

You have the right for reasons resulting from your specific situation at any time to object to the processing of personal data relating to you which arises due to article 6, para. 1, letter e or f of the GDPR; this also applies to profiling based on these provisions.
We no longer process the personal data applicable to you, unless we can prove compelling reasons worthy of protection for processing which outweigh your interests, rights and freedom or processing serves to assert, exercise or defend legal claims.

Right to Object to the Processing of Data for the Purposes of Direct Advertising

If your personal data is being processed for the purpose of direct advertising, you have the right to object to the processing of personal data relating to you for the purpose of such advertising; this also applies to profiling to the extent it is linked to such direct advertising. If you object to processing for the purpose of direct advertising, the personal data relating to you will no longer be processed for these purposes. You have the possibility, in connection with the use of information society services, regardless of Directive 2002/58/EC, to exercise your right to object by means of automated processes, in the case of which technical specifications are used.

12. No Obligation to Provide Personal Data

12.1

We do not make the conclusion of agreements with ourselves dependent on whether you provide us with personal data in advance. For you as the customer there is no legal or contractual obligation to provide us with your personal data; it can however be the case that we can only render certain offers to a limited degree or not at all, if you do not provide the necessary data. Should this exceptionally be the case within the framework of the products and services previously presented and offered by us, you will be separately informed of this.
